PayME Terms and Conditions

This Terms and Conditions (“Terms”) make up the entire agreement between you and PayMe. It is important that you read and understand all the Terms as your usage of the PayMe App (“App”) is governed by these Terms and other applicable laws, rules and regulations. By accepting these Terms and using the App, you represent that you have the contractual capacity and capability to enter into legally binding contracts; and that you have read and understood all the provisions of this Agreement. Otherwise, you must immediately stop using PayMe App.

The PayMe Application you downloaded on your device allows you to purchase products and services from merchants, and which will be debited from your personal banking account (“Account”).

To register and safely use the App, you must first create a profile and link your Account. You will be asked to provide complete and accurate personal information. In doing so, you acknowledge and agree to allow PayMe to access said information in accordance with these Terms. After generating your profile, you will be given an identity code to ensure that your log in access is safe.

PayMe App only works on compatible software and hardware.

For any software we offer to you through your device, any licensing agreement is between you and the software’s licensor. Notwithstanding said agreement, you will indemnify us for any breach of said agreement.

As to the licensor’s ownership of the software as provided on the App or rights of use of any licensor, PayMe makes no warranties.

For the App to function correctly and to prevent technical issues, you are required to use only the up-to-date version of PayMe App. You will be promptly notified by the online marketplace of your device’s operating system (“App Store”) of any updates or upgrades available to you. Likewise, the App may only be used on a compatible device as sanctioned by rules of usage provided in your App Store’s Terms.

In processing your transactions, make sure your banking facilities are available through your Account. Otherwise, we will not be taking instructions from you.

PayMe assumes that every instruction sent to us using your PayMe App account is a genuine one. Thus, we act on it.

Once a transaction is submitted, it cannot be reversed. You are expected to review the correctness of your purchase and details of your merchant before submitting it for processing. For that reason, any loss resulting from the erroneous details you entered is your sole responsibility.

Transactions are debited to your Account in real time. A confirmation notice will be sent to you as proof of the successful transaction. Otherwise, we have not received your order or instruction. Hence, you are advised to wait for the confirmation from us before making a repeated purchase to avoid repeated debit of your Account.

You are required to keep your log in details (“Access Codes”) confidential at all times. For your own protection, you agree never to disclose your Access Codes to anyone and to log out of the App after usage to prevent anyone from accessing it. You shall in all circumstances accept full responsibility for all transactions processed through the use of your Access Codes whether or not the transactions were made with your knowledge or your authority. It is understood that the Access Codes are known only to you and as such, all transactions effected using your Access Codes shall be conclusively presumed to be done by you or authorized by you. You shall hold PayMe free and harmless from any and all losses, damages or liabilities you shall suffer as a consequence or result of your disclosure of your Access Codes.

PayMe employs best security practices to ensure that your mobile transaction is safe and secure. Every usage and transaction using the App is protected by encryption. Likewise, your personal information is encrypted and only our authorized employees and agents have access to it.

PayMe reserves the right to suspend or terminate your PayMe App account and/or your access to the PayMe App at any time, without prior notice, if:

7.1 We discontinue the App services for any reason;
7.2 You violated any of the Terms of this Agreement;
7.3 There is a reasonable cause to believe that you are at risk for fraud or misuse;
7.4 We are experiencing technical difficulties;
7.5 PayMe has been ordered or recommended to so by proper authorities.

Upon termination, all rights granted to you for your usage and enjoyment of the App will cease immediately.

Should your Account be cancelled or stopped for any reason, PayMe may suspend your access to the App until you have registered a new Account for the App.

You expressly agree to indemnify PayMe for any loss or damage of whatever nature that we may suffer as a result of your: a) Failure to pay the required costs and fees; b) Incorrect instructions or erroneous entry of information and details; c) Insufficient money in your Account to make necessary payments; and d) Negligence in safeguarding your Access Codes resulting to unauthorized transactions made on your behalf.

You further consent that:

The Terms and Conditions is a contract between you and PayMe. Considering that the App is available through a third party, the App Store in this case, same third party in accordance with these Terms shall have the right to impose this Agreement against you;

App store does not represent nor warrant anything in relation to the App, its usage or any of its contents. Hence, it shall not be held liable for any claims, losses, costs or expenses in relation to the aforementioned to fullest extent permitted by law; and

Claims arising from the license, possession and use of the App are legal matters between you and PayMe.

In no event shall PayMe be held liable for your inability to access and use the App due to factors beyond our control, such as but not limited to, your Internet Service Provider’s (ISP) unavailability, or your device’s incapacity or incapability, technical issues prohibiting your access of the App, unauthorized use of your Access Codes,

PayMe, including its employees, agents, and consultants, shall be free of responsibility for any loss or damage resulting from your use of the App or any Intellectual Property issues that may arise from its use.

Your use of the App is at your own risk. Neither PayMe nor the third parties make any warranty as to information or materials found on the App.

You expressly agree and consent, to the collection, storage, processing, and disclosure of your personal information to PayMe’s affiliates, subsidiaries, agents, service providers, and other parties as required by law. Likewise, you agree to our administering, operating, and monitoring of your profile and Account for fraud, compliance and other risk-related purposes.

In sharing your personal information to other third parties, we will secure your expressed consent.

PayMe adheres to the best security measures in ensuring the safety of your transactions and privacy of your information. Accordingly, any information obtained from you will only be used in accordance with the terms of this Agreement.

A Cookie small text file stored on your device when you visit a website. Websites ask its visitors’ permission in utilizing cookies since such files identify and hold information about their visitors regarding their last visit.

PayMe uses cookies when you register, to authenticate you when you use the service, and to generally improve your experience on PayMe App. By using PayMe App, you accept our use of cookies as set out here. We use these cookies to collect information about your use of this app, for example which areas you use most often and if you receive any error messages. This information helps us improve the App’s performance, ensure the PayMe App’s experience, we deliver is relevant and develop our products and services for you and other users. This information may also be used to help us provide more meaningful and relevant communications to you.

Most mobile phones are set to accept cookies by default. If you prefer, you can change your settings to reject or decline cookies. However, this may prevent you from taking maximum use of the PayMe Mobile Application.

You hereby authorize PayMe to use your personal information in notifying you of recent promotional offers, products and services, advertisements or other similar programs from us or other companies that may interest you by communicating to you through electronic mail, or by short messaging service (SMS). Should you wish not to be notified, contact us directly so we could exclude you.

For any breach of the provisions of this Terms and failure on your part to make the necessary remedial actions within five (5) days, you will be asked to refrain from using PayMe App. In addition, we may seek all remedies available at law and equity, including but not limited to, application for an appropriate court order against you.

Other than the license granted and subject to the Intellectual Property Rights of merchants and other third parties, PayMe owns all rights, title and interest in and to the App and all portions thereof, including without limitation, all intellectual property rights in connection therewith, unless otherwise consented in writing by us.

You are granted a revocable, non-exclusive and non-transferable license to use PayMe App. This license grant includes all updates and upgrades for your use as covered by these Terms.

The grant of the license commences from installation of App on your device and continues unless terminated in accordance with the Terms. Upon termination of the license granted, usage of the App will immediately cease.

For contents made available through the App that belong to third parties, we may provide you links to their websites. Under no circumstance will PayMe be held liable for inaccuracies and reliance you placed on the contents belonging to third parties. You are not allowed to copy, alter, or reproduce in any form, the contents belonging to third parties as appearing on the App or through their respective websites through links that are found on the App. Said contents are the exclusive Intellectual Property of the third parties.

You acknowledge and agree that any improper or unauthorized use of the contents or links of the third parties gives us sufficient cause to claim indemnity against you, including costs related to the legal action resulting therefrom.

We may amend this Agreement at any time by providing you a written notice of the changes made.

If any part of these Terms is found to be invalid, illegal or unenforceable, the remaining parts will continue in full force and effect.

Our registered address as appearing on our website is where any legal document or notice must be delivered or sent.

For legal documents or notices, they shall be mailed to your registered address based on our records. Other communications may be sent to you through electronic mail, or through the App message system.

Electronic communications shall be deemed to be received by you a day after it was sent to your e-mail address.

These Terms and Conditions shall be governed by and construed in accordance with existing Egyptian Laws. Anyone using the PayMe App submits to the exclusive jurisdiction of the courts in Egypt.
